1. Acceptance of Terms

By accessing or using the services provided by Black Cat Clapping AI ("Service", "we", "us", or "our") at https://blackcatclappingai.com, you agree to be legally bound by these Terms of Service ("Terms"). If you do not agree to all terms and conditions set forth herein, you must immediately discontinue your use of the Service.

2. Description of Service

Black Cat Clapping AI provides an artificial-intelligence-powered video animation service that transforms user-uploaded pet and animal imagery into stylized, viral human-hands clapping animations, meme clips, green-screen videos, and animated GIFs.

We reserve the right to improve, modify, suspend, or discontinue any aspect of the Service at any time, with reasonable notice where practical.

3. Accounts & Credits System

A. Account Security

To access video generation features, you must create an account via Google Single Sign-On (SSO) or email. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

B. Credits & Consumption

  • Generating an AI video or unlocking high-resolution downloads consumes a predetermined number of Credits.
  • We may award free initial credits to newly registered accounts at our sole discretion.
  • Additional credits can be purchased as one-off packs or subscription plans.
  • Credits are non-transferable, possess no monetary cash value, and expire only according to the stated terms of specific promotional grants.

4. User Content & Intellectual Property

A. Your Uploaded Content

  • You retain full ownership and intellectual property rights in any images or content you upload to the Service.
  • By uploading content, you warrant and represent that you possess the necessary licenses, rights, or permissions to upload and process the media.
  • You grant Black Cat Clapping AI a non-exclusive, worldwide, royalty-free, limited license solely to host, process, and transmit your media as necessary to render the requested AI animation.

B. Ownership & Commercial Rights of Generated Output

  • You own the resulting video outputs and animated media generated from your tasks.
  • Subject to full compliance with these Terms, Black Cat Clapping AI grants you full, perpetual, royalty-free commercial and non-commercial rights to download, publish, broadcast, distribute, and monetize your generated videos across any platform (including TikTok, YouTube, Instagram, X/Twitter, and advertising networks).

C. Platform Intellectual Property

  • All rights, titles, and interests in the Black Cat Clapping AI platform, algorithms, website design, trademarks, logos, audio tracks, and user interfaces belong exclusively to us and our licensors.

5. Acceptable Use Policy (Prohibited Activities)

You agree not to use the Service to:

  1. Upload Prohibited Material:
    • Sexually explicit, pornographic, or NSFW imagery.
    • Violent, abusive, gory, hateful, or harassing content.
    • Photos of minors or individuals without their explicit informed consent.
    • Content infringing upon any third party's copyrights, trademarks, publicity, or privacy rights.
  2. Deceptive Deepfakes: Create misleading, defamatory, or fraudulent synthetic media intended to harm, defraud, or impersonate real individuals maliciously.
  3. System Interference: Probe, scan, reverse-engineer, exploit vulnerabilities, or initiate denial-of-service (DoS) attacks against our infrastructure.
  4. Automated Scraping: Use automated scrapers, crawlers, or bots to harvest data or abuse generation endpoints without prior authorization.

Violations of this section will result in immediate termination of your account, forfeiture of all remaining credits, and possible legal action.

6. Payment, Billing, and Refund Policy

A. Payment Processing

All payments are processed securely through accredited third-party payment gateways (e.g., Stripe). Prices are quoted in USD or other stated currencies and include applicable sales taxes where mandated.

B. Digital Goods & Compute Costs

Because AI video generation immediately allocates dedicated GPU computing resources upon task initiation, credits consumed by successfully completed video tasks are non-refundable.

C. Failed Generations

If an AI video task fails or errors out due to a technical glitch, server error, or network timeout on our side:

  • The credits deducted for the failed task will be automatically refunded to your account balance.
  • In the event of an unrecovered system issue, contact our support team at support@blackcatclappingai.com for prompt credit restoration or resolution.

7. Disclaimer of Warranties (AI Output "As-Is")

THE SERVICE AND ALL AI-GENERATED OUTPUTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

Given the probabilistic nature of generative artificial intelligence:

  • We do not warrant that generated videos will match your exact subjective aesthetic expectations.
  • We do not warrant that the Service will be completely uninterrupted, error-free, or entirely bug-free at all times.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BLACK CAT CLAPPING AI, ITS DIRECTORS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, USE, OR GOODWILL) ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO USE) THE SERVICE.

OUR AGGREGATE LIABILITY TO YOU FOR ANY CLAIM WHATSOEVER SHALL NOT EXCEED THE GREATER OF $50 USD OR THE TOTAL AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Termination

You may terminate your account at any time. We reserve the right to suspend or terminate your account and access to the Service without prior notice if you breach any provision of these Terms or engage in conduct deemed harmful to the community or our infrastructure.

10. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms shall be resolved through good-faith informal negotiations before initiating formal legal proceedings.
